Introduction

The terms and conditions apply between a person (hereinafter referred to as the Customer) and the owner of Fra Mare Thalasso Spa AS Heal, both when purchasing on site and through the shopping environment https://www.framare.ee/?lang=en​ (hereinafter Fra Mare Thalasso Spa e-shop) regarding the legal relationships arising when booking accommodation services, purchasing services, products and gift cards.

In addition to these terms and conditions, legal relationships arising from the purchase of products via the Fra Mare Thalasso Spa website are regulated by the Law of Obligations Act, the Consumer Protection Act and other applicable legislation in the Republic of Estonia.

Only legally capable persons aged at least 18 years may make transactions in the Fra Mare Thalasso Spa online store. The person whose bank account or bank card was used to make the payment shall be liable for the consequences of orders placed by a person not meeting the requirements.

Prices

1. The prices displayed to the customer are in euros, including taxes established in the Republic of Estonia, and are valid only for the period selected on the website https://www.framare.ee/?lang=en
2. All purchases are paid in euros (EUR).
3. The exact prices for the booked accommodation and services are displayed before booking and during the booking process.
4. The prices shown are valid for accommodation and services on the selected dates.
5. The price does not include additional services unless otherwise stated when booking.
6. Fra Mare Thalasso Spa always shows the total price of the order in the booking confirmation.
7. If the reservation has not been paid for in advance, it must be paid in local currency upon arrival at the Hotel. You can pay at the hotel: in cash, VISA, MasterCard and Estonian bank cards.

Buying a gift card, booking services

1. The customer selects from the website menu: to purchase a gift card – “buy a gift card” or to purchase accommodation and services – “book”.
2. From the booking menu, you can select “rooms and packages” to purchase accommodation and packages or “treatments” to purchase spa services.
3. The customer selects the services to be purchased and fills in the required fields.
4. After entering the required data and checking the accuracy of the data, the customer confirms the order by clicking “Submit order”. After this activity, the order has been confirmed and forwarded to Fra Mare Thalasso Spa.
5. The customer pays for the gift card and treatments immediately via a bank link and confirms the payment by clicking the “Return to merchant” button. The customer has the option to pay for accommodation and packages on the website via bank link or card payment or upon arrival at the hotel reception.

            5.1. After paying for the gift card, Fra Mare Thalasso Spa will send the invoice and gift card to the customer’s email.

            5.2. After paying for the treatment, Fra Mare Thalasso Spa will send a confirmation letter to the customer’s email.

            5.3. After payment or confirmation of the accommodation or package reservation, Fra Mare Thalasso Spa will send a booking confirmation to the customer’s email.

Payment Terms

1. For services purchased by the customer through the Fra Mare Thalasso Spa website, the full cost of the selected service (product) must be paid. By making a payment, the customer confirms that they have read and accepted all terms and conditions made available by the service provider through the website.
2. You can pay for your order using a bank link, by transfer via internet banking, or by card payment.
3. All payments are processed by Montonio Finance OÜ. After paying for the goods, the customer must click on the “Return to merchant” link.
4. Upon receipt of the order and payment, Fra Mare Thalasso Spa will send the customer a booking confirmation and (or) invoice by email.
5. Gift cards purchased from the online store cannot be issued on site at the hotel.

Delivery terms – order cancellation and refund

When purchasing a gift card from the Fra Mare Thalasso Spa online store, the customer has the right to withdraw from the sales contract within 14 days from the date of receipt of the gift card, i.e. the day Fra Mare Thalasso Spa sent the gift card to the requested email address. The customer must send a statement of withdrawal from the sales contract to the e-mail address sekretar@framare.ee. You cannot withdraw from the transaction if the gift card has already been used.

In the event of withdrawal from the sales contract, Fra Mare Thalasso Spa will refund the purchase amount to the customer within 14 days of receiving the withdrawal form from the sales contract. The refund will be made to the same bank account from which the customer paid for the returned order. In the event of a return of the order, Fra Mare Thalasso Spa will refund the entire amount received under the contract to the Customer.

After payment is made, the purchased gift card will be sent to the customer via email as a downloadable and printable voucher.

Using a gift card

The gift card cannot be exchanged for cash, Fra Mare Thalasso Spa will not buy it back or exchange it. If the cost of the desired products or services is less than the value of the gift card, the deposit will not be refunded. If the cost of the desired products or services exceeds the value of the gift card, the remaining amount can be paid with other accepted payment methods.

Gift cards are valid for 12 months from the date of purchase. For seasonal services, the gift card has a shorter validity period. Gift cards with a fixed amount have no expiration date. Once the validity period has expired, the gift card becomes invalid and cannot be returned or exchanged.

When booking accommodation

• Cancellation fee with prepayment: When returning the prepayment, the hotel has the right to withhold 10% of the order amount as a service fee.
• The latest cancellation time for a reservation is 48 hours before the arrival date.
• For bookings with flexible cancellation terms, the cost of the next night will be taken as compensation, all remaining nights will be refunded.
• Fra Mare thalasso Spa Hotel does not take a deposit, but reserves the right to charge the guest’s bank card for damage to the room or broken items as compensation for cleaning the room.
• Check-in for rooms takes place at Fra Mare Thalasso Spa Hotel from 3:00 PM.
• Check-out time at Fra Mare Thalasso Spa Hotel is 12:00 and there is a surcharge for late check-out.

When booking treatments

• The latest cancellation time for a treatment reservation is 48 hours before the day and time of the treatment.
• In case of cancellation, no refund will be made, but a gift card of the same amount will be sent.
• Please arrive 10 minutes before the treatment start time.
• No refunds will be given in case of late arrival or no-show.

Privacy Policy

Personal data provided when ordering and purchasing at Fra Mare Thalasso Spa e-shop and website is confidential and will be processed in accordance with data protection law and Heal AS Privacy Policy. Fra Mare Thalasso Spa will not disclose a customer’s personal information to third parties without the customer’s consent. Heal AS as the controller of personal data forwards the personal data necessary for the making payments to the authorized processor Montonio Finance OÜ.

Other terms and conditions

Disputes between the customer and AS Heal regarding the ordering and purchase of products through Fra Mare Thalasso Spa e-shop and website will be resolved through negotiation. If an agreement is not reached, the Customer has the right to contact the Consumer Protection and Technical Regulatory Authority to protect their rights. Disputes and issues not covered by these terms and conditions will be resolved in accordance with the legislation in force in the Republic of Estonia.
